Welcome to Maison Jean. P. The terms "we", "us" and "our" refer to Maison Jean. P, a company registered in the Netherlands (KvK: 75565919). Maison Jean. P operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the "Services"). Maison Jean. P is powered by Shopify, which enables us to provide the Services to you.

The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services.

By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms or our Privacy Policy, you should not use or access our Services. Nothing in these Terms limits your statutory rights as a consumer under Dutch and EU law.

SECTION 1 - ACCESS AND ACCOUNT

By agreeing to these Terms, you represent that you are at least the age of majority in your country or region of residence. To use the Services, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all the information you provide is correct, current and complete.

You are solely responsible for maintaining the security of your account credentials and for all of your account activity. You may not transfer, sell, assign, or license your account to any other person.

SECTION 2 - OUR PRODUCTS

We have made every effort to provide an accurate representation of our products. Colors or product appearance may differ from how they appear on your screen due to your device settings. All product descriptions are subject to change at any time without notice. We reserve the right to discontinue any product at any time and may limit the quantities of any products we offer.

SECTION 3 - ORDERS

When you place an order, you are making an offer to purchase. Maison Jean. P reserves the right to accept or decline your order at its discretion. Your order is not accepted until Maison Jean. P confirms acceptance and we have processed your payment. Please review your order carefully before submitting.

If we do not accept, change, or cancel your order, we will notify you via the email or phone number you provided.

Your purchases are subject to return or exchange in accordance with our Refund Policy and your statutory right of withdrawal (see Section 8).

SECTION 4 - PRICES, BILLING AND VAT

Prices are displayed in USD on our store. For EU customers, prices include applicable VAT (BTW). The total price including any shipping or other charges is shown at checkout before you complete your purchase.

Prices, discounts and promotions are subject to change without notice. The price charged for a product will be the price in effect at the time the order is placed and confirmed in your order confirmation email.

You agree to provide current, complete and accurate purchase, payment and account information. You represent and warrant that the payment information you provide is true, that you are authorized to use it, and that the charges will be honored by your provider.

SECTION 5 - SHIPPING AND DELIVERY

Delivery times are estimates only. We are not liable for delays caused by carriers, customs processing, or events outside our reasonable control. Once we transfer products to the carrier, risk of loss passes to you, in accordance with applicable consumer law for B2C deliveries.

SECTION 6 - LEGAL GUARANTEE (CONFORMITY)

In accordance with Dutch and EU consumer law, you are entitled to a legal guarantee of 2 years from the date of delivery on all products purchased from Maison Jean. P. This means that any product that is defective, not as described, or not fit for purpose at the time of delivery will be repaired, replaced, or refunded at no cost to you.

If a defect is discovered within the first 6 months after delivery, the defect is presumed to have existed at the time of delivery, unless we can demonstrate otherwise (Article 7:18a Dutch Civil Code).

This statutory guarantee is separate from and in addition to any commercial guarantee we may offer. Your statutory rights are not affected by any commercial guarantee terms.

To claim under the legal guarantee, contact us at customercare@maisonjeanp.com with your order number and a description of the defect.

SECTION 7 - RIGHT OF WITHDRAWAL (14-DAY COOLING-OFF)

As a consumer in the EU, you have the right to withdraw from your purchase within 14 calendar days of receiving your order, without giving any reason.

To exercise this right, you may use the model withdrawal form available in our Refund Policy, or send us an unambiguous statement at customercare@maisonjeanp.com before the 14-day period expires.

Exception: The right of withdrawal does not apply to personalised or custom-engraved products, as these are made to your specifications. This exception is clearly indicated on the relevant product pages.

SECTION 9 - INTELLECTUAL PROPERTY

Our Services, including all trademarks, brands, text, displays, images, graphics, product reviews, video, audio, and the design, selection and arrangement thereof, are owned by Maison Jean. P, its affiliates or licensors, and are protected by Dutch, EU and international intellectual property laws.

These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store, or transmit any of the material on the Services without our prior written consent.

Maison Jean. P names, logos, product and service names, designs, and slogans are trademarks of Maison Jean. P. You must not use such trademarks without our prior written permission.

SECTION 10 - OPTIONAL TOOLS AND THIRD-PARTY LINKS

The Services may contain links to or tools provided by third parties. We are not responsible for the content or practices of third parties, and access to third-party sites is at your own risk.

We are not liable for any harm or damages related to your access of any third-party websites or your use of any third-party products or services. Please review the third party's policies before engaging in any transaction.

SECTION 11 - RELATIONSHIP WITH SHOPIFY

Maison Jean. P is powered by Shopify. All sales and purchases are made directly with Maison Jean. P. Shopify is not responsible for any aspect of any sales between you and Maison Jean. P.

SECTION 12 - PRIVACY

All personal data we collect through the Services is processed in accordance with our Privacy Policy and applicable GDPR/AVG regulations.

Information you submit may be transmitted to and shared with Shopify and other service providers, who may be located in countries other than where you reside, in order to provide the Services to you. See our Privacy Policy for full details.

SECTION 13 - FEEDBACK

If you submit any ideas, suggestions, feedback, reviews, or other content ("Feedback"), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute and display such Feedback for any purpose.

You represent and warrant that: (i) you own or have all necessary rights to your Feedback; (ii) your Feedback does not violate the rights of any third party; and (iii) your Feedback complies with these Terms.

We may, but have no obligation to, monitor, edit or remove Feedback that we determine to be unlawful, offensive, or otherwise objectionable.

SECTION 14 - ERRORS, INACCURACIES AND OMISSIONS

Occasionally there may be information on the Services containing typographical errors, inaccuracies or omissions related to product descriptions, pricing, promotions, shipping charges, transit times or availability. We reserve the right to correct any errors and to change or update information at any time, including after you have submitted your order, in accordance with applicable consumer law.

You may not use the Services: for any unlawful or malicious purpose; to violate any laws or regulations; to infringe intellectual property rights; to harass or harm any person; to transmit false or misleading information; to send spam or chain communications; to impersonate any person or entity; or to interfere with the security or operation of the Services.

You also agree not to upload viruses or malicious code, scrape or crawl the Services, or circumvent any security features. We reserve the right to suspend or terminate your access if we determine that you have violated these Terms.

SECTION 16 - LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Maison Jean. P's liability arising out of or in connection with your purchase or use of the Services is limited to the purchase price of the relevant product.

Nothing in these Terms limits or excludes our liability for:

  • death or personal injury caused by negligence;
  • fraud or fraudulent misrepresentation;
  • any liability that cannot be limited or excluded under Dutch or EU consumer law;
  • your statutory rights under the legal guarantee (Section 6) and right of withdrawal (Section 7).

SECTION 17 - INDEMNIFICATION

You agree to indemnify and hold harmless Maison Jean. P and our affiliates, officers, employees and agents from any claims, damages or liabilities arising from (1) your breach of these Terms, (2) your violation of any law or the rights of a third party, or (3) your unauthorized use of the Services. This indemnification does not apply to the extent prohibited by applicable consumer law.

SECTION 18 - SEVERABILITY

If any provision of these Terms is determined to be unlawful, void or unenforceable, that provision shall be enforceable to the fullest extent permitted by law, and the unenforceable portion shall be severed without affecting the validity of the remaining provisions.

SECTION 19 - ENTIRE AGREEMENT

These Terms of Service, together with our Privacy Policy, Refund Policy, and Shipping Policy, constitute the entire agreement between you and Maison Jean. P regarding your use of the Services, superseding any prior agreements.

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

SECTION 20 - ASSIGNMENT

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer these Terms and our rights and obligations without your consent, provided that your rights as a consumer are not adversely affected.

SECTION 21 - GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of the Netherlands. Any disputes arising from or relating to these Terms or your use of the Services shall be subject to the jurisdiction of the competent courts in the Netherlands, without prejudice to your rights as a consumer under mandatory local law in your country of residence.

SECTION 22 - CHANGES TO TERMS

We reserve the right to update these Terms at any time. Material changes will be communicated in accordance with applicable law and will take effect on the date specified in the notice. Your continued use of the Services following the posting of any changes constitutes acceptance of those changes.
